HELP US IDENTIFYING BENAMI TRANSACTION HOLDERS
Benami transaction is now a criminal offense under the law, punishable by rigorous imprisonment of one to seven years. The law also mandates cash rewards for those who help bring Benami properties to light.
What is a Benami Transaction?
® A property (movable and immovable) is held in a fictitious name. ® The owner of a movable and immovable property is not aware of such ownership. ® The person providing the consideration is not traceable or is fictitious. ® A property (movable and immovable) held by a person who has not provided for its consideration.
What is not a Benami Transaction?
Properties (movable and immovable) lawfully acquired through known resources and transferred to or held in the name of trustees, wife, children, brother, or sister are not considered benami.
PROPERTY WORTH REWARD
5 % of the price of Benami property
More than Rs.2,000,000 and up to Rs. 5,000,000
4 % of the price of Benami property
3% of the price of Benami property
More than Rs.5,000,000
The whistleblower s identity will be kept secret
Persons providing false information can also be sentenced to rigorous imprisonment of six months to five years.
